Right to Rectification & Notification (Art. 16 & 19)

⚡ In 30 seconds

Under Article 16, data subjects have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning them and to have incomplete personal data completed. Under Article 19, the controller must notify all recipients of any rectification unless this proves impossible or involves disproportionate effort.

Material Rectification (Art. 16)

Correcting objective factual mistakes: erroneous spelling of names, wrong birth dates, mistaken payment records, invalid address logs.

Cascading Notification (Art. 19)

The controller must communicate any rectification to each recipient (processors, partners, brokers) to whom the personal data have been disclosed.

⚡ Key Takeaways
  • Direct operational counterpart to the core principle of accuracy (Art. 5.1.d).
  • The data subject has the right to add a supplementary statement to contextualize dispute records.
  • Under Art. 19, the controller must inform the data subject about those recipients if requested.
⚠️ Common Pitfall

Refusing to rectify a credit file or HR record because the data was technically accurate at the moment of historical collection.

🛠️ In Practice

Build automated webhook triggers to broadcast record updates across connected API endpoints whenever a user profile is amended.

✓ Key takeaways

  • Statutory right to correct materially inaccurate personal records without undue delay.
  • Right to have incomplete personal data completed, including by supplementary statements.
  • Proactive obligation (Art. 19) to cascade rectifications downstream to all third-party recipients.
